We have a brand new trailer for Into the Ashes. In any given year, a number of movies will slip through the cracks for may viewers, simply because there is so much stuff being released on a variety of platforms. It's impossible to keep up, especially during the very crowded summer movie season. This movie runs the risk of succumbing to such a fate, but based on this first trailer, maybe it shouldn't. Frank Grillo (Captain America: The Winter Soldier) leads the way in what looks like it very well could be an under the radar action/thriller to keep an eye on.
The trailer kicks off with a lot of ominous and clearly vengeful voiceover that leads to a tense confrontation between two men whose beef will be at the center of this tale. There is some action to behold, but the footage goes a little light on the guns and body count. Instead, it favors atmosphere and tone. Everything appears to be very stark and bleak. Even the gunshots themselves are muted. It seems to be positioning this as more of an examination of vengeance, as opposed to a gritty shoot-em-up. Admittedly, it does a pretty effective job.
Into The Ashes centers on an ex-con named Nick Brenner (Frank Grillo). He now has an honest job and a wife he lives and thinks he's managed to escape his violent criminal past. However, his crew hasn't forgotten about him or the money he took from them. When they take Nick's wife, the thing most precious to him, he is left with nothing to lose. Confronted by the town sheriff/ father-in-law, this troubled man must decide if he will stay on his new path, or head out on a path of revenge to get even with his enemies for what they've taken from him.
Frank Grillo has proven himself to be an action star to watch. Outside of his work in the Marvel Cinematic Universe, he's starred in movies such as Wheelman, The Grey and a couple of entries in The Purge series. The cast also includes Luke Grimes (American Sniper, Yellowstone), Robert Taylor (The Matrix, Vertical Limit), James Badge Dale (13 Hours: The Secret Soldiers of Benghazi, World War Z), Marguerite Moreau (Wet Hot American Summer, Queen of the Damned) and Andrea Frankle (The Reaping, 21 Jump Street).
For what it's worth, Frank Grillo did appear in a cameo role in Avengers: Endgame. So, technically speaking, this movie stars a man who stars in the second-highest-grossing movie of all time. In addition to the trailer, the studio has also released an equally stark new poster that leans heavily into the title. Aaron Harvey (The Neighbor) serves as both writer and director. This post summarizes an August 2018 memo from Centers for Medicare and Medicaid Services (CMS) Administrator Seema Verma to the Department of Health and Human Services (HHS) Secretary Alex Azar on recommendations regarding policy issues in the 2020 payment rule. It also discusses several actions by CMS. On June 17, 2019, CMS released proposed updates to part of the risk adjustment methodology and an updated exchange blueprint application for states interested in operating their own state-based exchange. CMS separately approved “vertical choice” for the small business exchanges operated by the federal government in all but one state.
Memo On 2020 Payment Rule Changes
On June 14, Democratic leadership of the House Energy and Commerce Committee, the Ways and Means Committee, and the Education and Labor Committee sent a letter to Secretary Azar expressing concerns about an internal memo sent by Administrator Verma in August 2018. The memo was unearthed in response to the House’s investigation into HHS’s role in the Texas v. United States lawsuit over the constitutionality of the individual mandate.
In the memo, Administrator Verma raises concerns about various policy proposals that were under consideration for the 2020 payment rule. She recommends against 1) banning silver loading; 2) making changes to the automatic reenrollment process; and 3) changing the method for calculating the premium adjustment percentage. She favorably recommends a national prescription drug count standard for the essential health benefits prescription drug benefit beginning in 2021.
For each of these policies, the memo analyzes the impact on enrollment and premium tax credit outlays. If the first three policies were all adopted for 2020, the Office of the Actuary estimates that exchange enrollment would decline by about 10 percent, or 1.1 million individuals. Further, the policies would result in individual market disruption, potentially lead to bare counties, and have a disproportionate impact on unsubsidized enrollees. Other considerations the memo mentions: states need a stable policy environment to explore using Section 1332 state innovation waivers, and non-Affordable Care Act (ACA) plans (such as short-term plans and association health plans) “may not be a viable option for unsubsidized enrollees with pre-existing conditions who cannot undergo underwriting.”
Premium Adjustment Percentage
Despite these recommendations, CMS proposed and then finalized an updated premium adjustment percentage in the 2020 payment rule. The new methodology means a higher annual limit on out-of-pocket costs (which applies to individual and group plans) and higher premiums for those who qualify for premium tax credits. The change will reduce federal premium tax credit spending but will result in higher premiums and coverage losses. This change was uniformly opposed by commenters, many of whom argued that the new methodology is flawed.
The memo shows that CMS was aware of this impact and notes that the change “increases taxes on issuers and consumers—both directly and indirectly.” The tax on insurers is because a higher index rate results in a steeper health insurance tax. CMS also acknowledges in the memo that this policy change could result in adverse selection against the exchange, since subsidy-eligible healthy enrollees would be expected to drop coverage as premiums increased. CMS concludes its recommendation (which is shared by the Department of Treasury) by noting that changes to the premium adjustment percentage would cause “coverage losses, further premium increases, and market disruption.” The change was finalized anyway.
Silver Loading And Auto Reenrollment
Although CMS asked for comment in the proposed 2020 payment rule on whether to prohibit silver loading or make changes to the automatic reenrollment process, it did not finalize changes and assured stakeholders that it would not do so until plan year 2021 (if at all). According to the memo, requiring insurers to load cost-sharing reductions across all metal levels would increase premiums for non-silver plans by 11 percent and reduce silver plan premiums by five percent. It would also result in coverage losses of about 300,000 in 2020. These impacts varied by state, however, with much higher premium impacts in states such as Florida and Texas.
The memo estimates that ending the automatic reenrollment process would result in 200,000 fewer individuals enrolled through the exchanges in 2020 and 100,000 fewer each subsequent year. Premiums would be about 1 percent higher because those using this process are expected to be healthier. Combined with elimination of the individual mandate penalty and the expansion of non-ACA plan options, changes to this process would exacerbate concerns about the health of the risk pool. The memo also notes that changes would stress the enrollment and eligibility system: requiring active reenrollment would make more consumers unable to complete the enrollment process at HealthCare.gov by December 15, resulting in the need for additional resources to increase system capacity.
National Prescription Drug Standard
The agency proposed, but largely did not finalize in the 2020 payment rule, a series of changes to prescription drug benefit standards. CMS did not, however, propose a national prescription drug count standard for 2020. Based on the memo, CMS was considering a national drug count minimum and maximum standard that would apply uniformly across all states. This is far different from the current standard which requires plans to cover the greater of 1) one drug per United States Pharmacopeia category and class; or 2) the number of drugs in the state’s benchmark plan.
States could adopt the federal count or establish their own formulary benchmark. But states that exceeded the federal maximum would be required to defray the cost of the difference, and drugs that exceed the maximum threshold would not be considered essential health benefits. The memo recommends using the 60th percentile of all states’ current benchmark plan formularies, at the category and class level. One of the memo’s appendices summarizes, on a state-specific basis, the effect of moving to a 60th percentile standard for prescription drug counts.
The memo acknowledges that this could result in “skinnier” coverage options and the possibility of adverse selection against certain insurers, but such a proposal would help limit premium growth and encourage accountability for prescription drug costs. More details are needed, but this could be a major potential change to watch for the 2021 payment rule.
Proposed Risk Adjustment Updates
On June 17, CMS released a paper summarizing potential future updates to its risk adjustment model. The risk adjustment program transfers funds from lower-risk, non-grandfathered plans in the individual and small group markets to higher-risk, non-grandfathered plans, both in and out of the exchange. The risk adjustment model predicts plan liability for medical and drug spending based on risk scores. These risk scores are based on enrollee age, sex, and diagnoses. Diagnoses are also referred to as hierarchical condition categories (HCCs).
In the paper, CMS identifies updates to the risk adjustment program that may be made in future rulemaking. The goal of the paper is to “familiarize” stakeholders with CMS’ work in this area and the ideas under consideration for HCC updates. The agency is not asking for comment on these changes now but will solicit public comment in the future during the annual rulemaking process. (Changes to the risk adjustment program are typically made through the annual payment notice; more information on how the risk adjustment program will be implemented for the 2020 plan year is available here.)
The most significant change CMS discusses is incorporating HCCs based on updated diagnosis codes, known as the International Classification of Diseases, Tenth Revision (ICD-10), rather than the current ICD-9 codes. When the United States implemented the ICD-10 codes in October 2015, the ICD-10 codes were cross-walked to ICD-9 codes and to existing ICD-9-based HCC classifications.
CMS believes that ICD-10 reclassification would better incorporate coding changes made in the transition to ICD-10 diagnosis codes into the HCC models. The agency’s analysis was informed by enrollee-level EDGE data from 2016 and 2017 that reflects the first two full years of ICD-10 diagnosis coding on claims. Using this data, CMS was able to evaluate the impact of potential changes to HCC classifications.
Beyond ICD-10 changes, CMS discusses other components of HCC classification. These include payment and non-payment HCCs, certain clinical hierarchies (e.g., substance use disorder), and severe illness and other HCC interactions affected by potential changes.
Updated Exchange Blueprint Application
Also on June 17, CMS posted its updated exchange blueprint application. States that want to operate their own state-based exchange (SBE) or state-based exchange that uses the federal platform (SBE-FP) must complete the blueprint application. The application is used to document that all the necessary legal and operational requirements to operate an exchange have been satisfied.
The first blueprint application was published in 2012 and has been updated over time to reflect various exchange models and changes to exchange program requirements. CMS accepted public comment on the revised application in April and August 2018 and received final approval for the application in November 2018. In early May 2019, CMS released a series of frequently asked questions (FAQs) about the blueprint application.
The revised blueprint application is effective for states that want to operate their own exchange on or after January 1, 2019. These states must submit a declaration of intent letter and a completed application. To operate an SBE, a state must submit a completed blueprint application at least 15 months before the exchange would begin open enrollment; for SBE-FPs, states must do so at least 3 months prior. However, CMS encourages states to submit the declaration of intent letter as early as possible: the agency recommends that letters be submitted no later than 21 months in advance of open enrollment for an SBE and nine months in advance for an SBE-FP.
As noted previously in the FAQs, the revised blueprint application reflects regulatory changes that have been adopted through recent CMS regulations on the exchanges and market reforms. The new blueprint is also designed to work in conjunction with the agency’s new approach to Section 1332 waivers. Many of the waiver concepts that CMS is encouraging states to consider (such as state-specific premium assistance and adjusted plan options) would be far easier to implement if a state had its own exchange.
Vertical Choice In The SHOP
Employee choice was touted as a significant benefit of the Small Business Health Options Program (SHOP). Through the SHOP, employers could select a premium contribution level and then let each employee select their preferred plan option from among the SHOP options.
For a variety of reasons, however, there has been relatively low enrollment through the SHOP exchanges. This led the federal government to essentially wind down the SHOP exchanges in the 2019 payment rule after CMS concluded it was no longer cost-effective for the federal government to maintain a SHOP website and functionality. Thus, small employers no longer enroll using the SHOP platform and, instead, enroll through a SHOP-registered agent or broker or directly with an insurer.
CMS has, however, retained some SHOP standards. One of these standards is the availability of employee choice. CMS rolled out the option for “vertical” employee choice in the federal exchange in the 2017 payment rule. Prior to 2017, small employers in the federal SHOP exchange could select a single plan or allow employees to choose a plan within a single tier of coverage (such as any gold plan). Beginning in 2017, this was expanded to allow employees to select a plan from a single insurer (such as a Blue Cross Blue Shield insurer) at any offered coverage tier. In the 2019 payment rule, CMS clarified that SHOP employers may offer employee choice across metal levels and across insurers. However, the employer has to obtain enrollment materials from each insurer whose coverage it wants to offer to its employees.
State insurance regulators with a federal SHOP exchange can request that this “vertical” employee choice not be available in their state. 『X-ファイル』でクリエイターを務めるクリス・カーターは、米ハーバード大学のジョン・E・マック教授による報告書を読み、シリーズの着想を得たのだそう。
そこには、約370万人ものアメリカ人が自分は地球外生命体に誘拐されたと信じていると記されており、その報告書を読んだカーターは間もなくしてFOXにドラマのアイディアを伝え、『X-ファイル』が誕生することに。
そして超常現象とは関係ありませんが、1980年代に放送されたドラマ『こちらブルームーン探偵社』の主人公マディとデービッドの曖昧な相棒関係にもインスパイアされたとのこと。
その他には、シカゴを舞台に不可解な事件を描く1970年代のドラマシリーズ『事件記者コルチャック』にも、大きな影響を受けたとカーターは明かしています。
『羊たちの沈黙』のクラリスがモデル!
『X-ファイル』の主人公の一人となるダナ・スカリーFBI捜査官は、映画『羊たちの沈黙』(1991年)でジョディ・フォスターが演じたクラリス・スターリングFBI捜査官がモデルになっているのです。
スカリーはクラリスと同じ赤毛でファッションやボディランゲージも類似していて、ナンセンスを受け付けない態度やハッキリと自分の意思を伝える点も似ています。
そして、スカリーを演じるジリアン・アンダーソンは、『羊たちの沈黙』に登場するハンニバル・レクターの若かりし頃を描くドラマ『ハンニバル』で精神科医のベデリア・デュ・モーリアを演じていて、『羊たちの沈黙』にちょっとした縁があるのが興味深いですよね。

シーズン4第2話「ホーム」は、アメリカの地上波放送局で初めて“成人向け指定”されたエピソードになりました。
ペンシルバニア州で奇形の乳児の遺体が発見され、モルダー&スカリーが現地へ向かい調査を開始。2人は、昔から文明を拒んで近親相姦を重ねているとの悪い噂が立っているピーコック兄弟を訪ねて職務質問し、スカリーは検死により、乳児の奇形が近親交配で生じたことを発見します。
しかし、ピーコック家は兄弟だけで女性はいないはず…。もしかしたら、女性が誘拐されているのではないかと疑った2人は彼らの住居に侵入し、その結果、ベッドの下で四肢を切断された兄弟の母親を発見する…という展開になっていました。
そして、この母親の容姿がかなり衝撃的で近親相姦というテーマも扱っているため、“成人向け指定”になったという訳です。当時、筆者はこのエピソードを見た時にかなりショックを受け、「これって、ちゃんとテレビで放送できたのかな…!?」と思ったことを覚えています。
ザ・スミスの曲だった!
なんといっても『X-ファイル』は、あのオドロオドロしいテーマ曲が有名ですよね。日本のバラエティ番組のホラーやオカルト特集では必ずといってよいほど使われていますが、あのテーマ曲は英ロックバンド、ザ・スミスの曲「How Soon Is Now」にインスパイアされているのだとか。ちなみに、この曲は1985年にリリースされたアルバム『Meat is Murder』に収録されています。
クライチェック役の俳優は2役以上演じていた!

『X-ファイル』では複数のキャラクターを演じた俳優がいるのですが、それはシーズン2からモルダーの相棒として加わり、数々の悪事を行ったアレックス・クライチェック役のニコラス・リーです。
アレックスはシーズン1第14話「性を曲げるもの」で、ナイトクラブで踊っているマイケルという役でも出演していました。
もともとクライチェック役は、SFドラマ『バトルスター・ギャラクティカ』などに出演しているカラム・キース・レニーにオファーされていたのですが、彼が出演を断わったためニコラスがクライチェックを演じることになったそうです。
最初スカリーには彼氏がいた!
『X-ファイル』の見どころのひとつは、お互いに微妙な感情を抱いているけれど長い間プラトニックを貫いていたモルダーとスカリーの関係ですが、なんとパイロット版では、スカリーにイーサン・ミネットという彼氏がいる設定になっていたのだとか。
なんでもシリーズの放送局であるFOXの重役に、モルダーとスカリーのプラトニックな関係にロマンス度が足りないと指摘され、クリエイターのカーターが彼氏を登場させたのですが、最終的にイーサンが出演しているシーンは全てカットされることに。
断然、引っ付きそうで引っ付かないモルダーとスカリーの関係の方が、ファンにとって興味深かったことは言うまでもなく、スカリーの彼氏を抹消して正解だったと言えそうです。
小柄なため台に載って撮影していた
身長183センチのデヴィッド・ドゥカヴニーと、160センチという小柄なジリアン・アンダーソンは身長差が23センチもあるため、ジリアンは撮影中のほとんどを台の上に立って演じ、そのジリアン専用の台は“ジリー・ボード”と呼ばれていたとのこと。
そして、演技に夢中になったあまり台に載っていることを忘れ、たまに台を踏み外したり転んでしまいそうになったこともあるそうです。
